# Acceptable Use Policy

**Last updated: September 21, 2026**

This Acceptable Use Policy (AUP) applies to every person or entity using Surge Communications Inc’s APIs, software, websites, and communications services, including anyone using those Services through a Customer application or account as an End User. Customers are responsible for making applicable requirements available to End Users and for End User compliance. This AUP forms part of our [Terms of Service](https://surge.app/terms/).

You may not use, or allow others to use, our Services for illegal, deceptive, abusive, harmful, or unauthorized activity.

## 1. Follow laws and messaging-industry rules

You must:

- Follow applicable laws, regulations, governmental orders, telecommunications-provider requirements, and industry standards for telemarketing, privacy, data protection, consumer protection, and communications.
- Complete required sender, brand, and campaign registrations, keeping submitted information complete, accurate, and current.
- Obtain and document all required consent before sending or initiating communications. Consent must fit the sender, recipient, content, and communication method; a purchased, rented, or shared list does not itself establish consent.
- Clearly identify the sender and communication purpose, provide required disclosures, and retain compliance records.
- Provide legally required opt-out instructions, promptly honor opt-outs and revocations, and maintain suppression lists so opted-out recipients are not contacted again without valid consent.

## 2. Prohibited communications and content

You may not transmit or facilitate:

- Spam, unsolicited communications, or communications generating excessive complaints, opt-outs, or other recipient-harm indicators.
- Fraud, scams, phishing, impersonation, misleading claims, deceptive offers, or falsified sender identity or message origin.
- Unlawful, threatening, harassing, defamatory, exploitative, discriminatory content, or content promoting violence or hatred against people based on a protected characteristic.
- Child sexual abuse material, sexual exploitation, non-consensual intimate imagery, or content facilitating human trafficking.
- Infringing or misappropriated intellectual property, privacy, publicity, confidentiality, or other rights.
- Malware, malicious code, credential theft, or links or attachments intended to compromise a device, account, network, or person.
- Products, services, or content prohibited by applicable law or traffic-carrying telecommunications providers, including where prohibited or restricted: controlled substances or cannabis, firearms, gambling, adult content, high-risk lending or debt relief, and third-party lead generation.
- Traffic pumping, access stimulation, artificially generated traffic, snowshoeing, SIM-box activity, number cycling, or activity intended to generate improper revenue, avoid detection, or evade carrier or Surge controls.

## 3. Protect the Services and communications networks

You may not:

- Attempt unauthorized access to our Services, another account, or a related system or network.
- Probe, scan, or test vulnerabilities except as expressly allowed by our [Vulnerability Disclosure Policy](https://surge.app/vulnerability-disclosure/).
- Interfere with, overload, disrupt, degrade, or disable our Services or connected telecommunications or third-party networks.
- Bypass or evade authentication, filtering, rate limits, usage limits, security controls, carrier registration, or other restrictions.
- Use bots, scripts, or automation abusively, scrape non-public data, or deceptively create accounts or traffic.
- Reverse engineer, decompile, disassemble, or copy our Services except where applicable law expressly permits it.

## 4. Protect data and credentials

Before transmitting or processing data, you are responsible for determining whether our Services provide safeguards required for your use. Use reasonable security measures for accounts, API keys, personal information, message content, and other data; restrict access to authorized persons; and promptly notify us of unauthorized access or use. Do not collect, use, disclose, or transmit data without legally required rights, notices, and permissions.

## 5. Customer responsibilities

You are responsible for activity through your accounts and applications, including activity by employees, contractors, customers, and End Users. Take reasonable steps to prevent and stop violations, respond promptly to complaints, and cooperate with our investigation and remediation efforts. Do not help another party evade this AUP or use the Services after suspension or termination.

## 6. Enforcement

We may investigate suspected violations; block content or traffic; limit functionality; quarantine or remove data; suspend or terminate access; or take other reasonable action to protect recipients, Surge, providers, and communications networks. We may act immediately and without prior notice when we reasonably believe activity creates a risk of spam, fraud, security harm, legal liability, network disruption, or carrier action. When reasonably practicable, we provide notice and an opportunity to remedy. We may report suspected illegal activity to authorities and cooperate with lawful requests.

## 7. Reporting violations

Report suspected violations, prohibited messages, or other abuse to [abuse@surge.app](mailto:abuse@surge.app). Include relevant phone numbers, message content, timestamps, and other helpful information. Customers must promptly report discovered violations and reasonably cooperate with investigation and remediation.

## 8. Changes to this policy

We may update this AUP. We provide reasonable notice of material changes through the Services, by email, or by posting an updated version here. Changes take effect on the date stated in the updated AUP. Continued use after that date constitutes acceptance of the updated AUP.
